Supplementary Terms for Pharmacy and Medication Consignments
(the “Pharmacy Supplementary Terms”)
1. Application and Priority
1.1 These Pharmacy Supplementary Terms apply in addition to the MyParcels Terms and Conditions (the “Core Terms”) where the Consignment includes medicines, medical products, or pharmacy‑supplied goods (“Pharmacy Consignments”).
1.2 In the event of any conflict or inconsistency between these Pharmacy Supplementary Terms and the Core Terms, these Pharmacy Supplementary Terms shall prevail in respect of Pharmacy Consignments.
1.3 References in the Core Terms to “you” or the “Customer” shall, for Pharmacy Consignments, be interpreted in accordance with Clause 2 below.
2. Parties and Roles
2.1 For Pharmacy Consignments:
“Pharmacy” means the registered pharmacy, online pharmacy, or authorised medicines supplier who had dispensed the medicine that the Recipient is seeking the courier service for via MyParcels.
“Recipient” means the end patient or consumer to whom the Pharmacy Consignment is addressed.
“You” / “Customer” for the purposes of contracting, instructions, and returns means the Recipient.
2.2 The Pharmacy is not a contracting party to MyParcels and does not provide delivery instructions directly to the courier.
3. Nature of Pharmacy Consignments
3.1 Pharmacy Consignments may include:
Prescription‑only medicines
Over‑the‑counter medicines
Liquid medicines, injectables, or temperature‑sensitive products
Ancillary pharmacy products supplied as part of a medicines order
3.2 Clause 6.3 of the Core Terms (Prohibited Items) shall not apply to Pharmacy Consignments, provided the items are lawful, properly packaged, and made available by a Pharmacy for a courier service in accordance with applicable law.
4. Delivery Controls (Override of Core Terms Clause 4.1)
4.1 Safe place delivery, delivery to neighbours, alternative addresses, lockers, parcel shops, forwarding services, or redirection is not permitted for Pharmacy Consignments.
4.2 Pharmacy Consignments must be delivered:
Only to the address specified by the Pharmacy; and
Only to the Recipient or a person authorised by the Pharmacy’s delivery instructions.
4.3 MyParcels may require, depending on the service selected:
Signature on delivery;
Proof of delivery; and/or
Age or identity verification where legally required.
4.4 Any Core Terms provision permitting delivery to a safe place or alternative location is expressly disapplied for Pharmacy Consignments.
5. Failed Delivery, Reattempts, and Holding
5.1 Where a Pharmacy Consignment cannot be delivered on the first attempt:
Where a Pharmacy Consignment cannot be delivered on the first attempt, the following applies:
(a) one reattempt may be made where the service rules permit;
(b) if still undelivered, the consignment may be held at an approved depot where compliant with handling requirements;
(c) if uncollected after the applicable holding period, the consignment will be returned to the originating Pharmacy or nominated pharmacy location.
The Recipient has no right to request redirection or alternative delivery arrangements.
5.2 Pharmacy Consignments may be held temporarily at an approved depot only where compliant with the handling requirements of the goods.
6. Returns and Undelivered Consignments
(Override of Core Terms Clause 4.2)
6.1 Where a Pharmacy Consignment is undelivered, refused, or cannot be lawfully completed:
The Consignment shall be returned to the originating Pharmacy or nominated pharmacy location, not to the Recipient.
6.2 Any reference in the Core Terms to return “to you” shall, for Pharmacy Consignments, mean return to the Pharmacy.
6.3 Return costs and arrangements for Pharmacy Consignments will be determined by the service selected and the Service Order. Where return to the Pharmacy is required, we may coordinate return logistics with the Pharmacy as the return destination.
7. Damaged, Compromised, or Unsafe Pharmacy Consignments
(Override of Core Terms Clause 4.3 and Clause 6.3)
7.1 MyParcels and its courier partners shall not dispose of Pharmacy Consignments unless expressly authorised by the Pharmacy or required by law.
7.2 Where a Pharmacy Consignment is damaged, compromised, or suspected to be unsafe:
The Consignment shall be isolated and handled in accordance with courier and pharmacy handling procedures; and
Returned to the Pharmacy for assessment, quarantine, or destruction under the Pharmacy’s professional obligations.
7.3 Any general right in the Core Terms to “dispose immediately” of goods does not apply to Pharmacy Consignments.
8. Courier and Network Restrictions
8.1 Pharmacy Consignments may only be carried by courier services approved by MyParcels for the transport of medicines, including where applicable couriers operating in accordance with Good Distribution Practice (GDP) standards.
8.2 Pharmacy Consignments must not be:
Delivered via parcel lockers, pick‑up shops, or forwarding services;
Consolidated with incompatible goods; or
Handled outside approved operational controls.
9. Liability and Regulatory Context
9.1 Nothing in these Pharmacy Supplementary Terms limits any statutory rights or obligations arising under UK medicines, healthcare, or consumer protection law.
9.2 MyParcels acts as a delivery intermediary and does not dispense, prescribe, or supply medicines.
9.3 Liability for the suitability, legality, and clinical appropriateness of medicines remains with the Pharmacy.
10. Amendments and Service‑Specific Rules
10.1 MyParcels may publish service‑specific delivery rules for Pharmacy Consignments from time to time.
10.2 Such rules shall form part of these Pharmacy Supplementary Terms once made available to the Pharmacy.
10. Delivery Confirmation
When using MyParcels courier services in conjunction with a Pharmacy service you agree that we may share delivery confirmations and order updates with the Pharmacy including where a consignment is undelivered and needs to be returned to them.
